General Terms and Conditions (AGB)

1. Scope of Application

These General Terms and Conditions (GTC) apply to all contracts for sleep consulting services concluded between Franziska Bothe, hereinafter referred to as the "Provider," and her clients.

​

2. Services

The Provider offers individual sleep consultations for parents of babies and toddlers up to 3 years old. The consultation is conducted online via video call and is based on scientifically validated, attachment-based methods.

3. Contract Conclusion & Booking

A contract is concluded when the client books a consultation via the website, email, or telephone and the Provider confirms the booking via email. The General Terms and Conditions and the Privacy Policy also apply to appointments arranged by phone.

4. Payment Terms

  • The invoice will be sent by email after the consultation has been conducted and is payable within 7 days via bank transfer.

  • The prices stated on the website apply.

  • Payment via PayPal or other online payment services is not available.

 

5. Cancellation & Appointment Rescheduling

  • Cancellations are free of charge up to 48 hours before the scheduled appointment.

  • For cancellations made later or in case of no-show, the full fee will be charged.

  • Should the provider have to cancel an already agreed appointment for important reasons (e.g., illness, technical problems), the customer will be informed immediately and offered an alternative appointment. No further claims, in particular for damages exist.

 

6. Note on the right of withdrawal for digital services

The consumer expressly agrees that the sleep consultation may begin before the expiration of the 14-day withdrawal period. It is pointed out that the right of withdrawal expires upon full fulfillment of the contract by the provider (Section 356 (4) of the German Civil Code).

7. Disclaimer of Liability

Sleep consulting does not replace medical or therapeutic care. Parents are responsible for implementing the recommendations. The Provider assumes no liability for the success of the consultation or for any consequences resulting from the application of the discussed strategies. Incorrect implementation or individual reactions of the child are the responsibility of the parents.

8. Final Provisions

Should any provision of these GTC be invalid, the validity of the remaining provisions remains unaffected.

When visiting the website and booking a consultation, personal data such as name, email address, and telephone number are processed.

  • Art. 6(1)(b) GDPR (fulfillment of a contract or pre-contractual measures, e.g., processing bookings)

  • Art. 6(1)(f) GDPR (legitimate interest in improving the services and usability of the website)

 

4. Purpose of Data Processing

  • Handling inquiries & bookings

  • Invoicing

  • Improving the services through anonymized usage analysis

 

5. Data Sharing

Personal data will not be shared with third parties unless there is a legal obligation or a data processing agreement has been established with external service providers.

6. Hosting & Third-Party Services

This website is hosted by Ionos (www.ionos.de). The personal data transmitted via the website is stored on the provider’s servers. If external services such as Google Meet or Zoom are used for sleep consultations, the processing follows their respective privacy policies.

7. Data Storage

Data is stored only as long as necessary for the purposes stated or as required by statutory retention periods.

8. Rights of Data Subjects

Users have the right to:

  • Access their stored data (Art. 15 GDPR)

  • Rectification of incorrect data (Art. 16 GDPR)

  • Erasure of data unless a legal retention obligation exists (Art. 17 GDPR)
